Quick Answer: What Is Happening With Herndon Development?
Last updated October 2026
Quick answer: two places drive most of Herndon’s development news. Downtown, a roughly five-acre Town-owned block at Elden and Center streets went to developer Comstock for a mixed-use project that never got built; after Comstock withdrew in December 2024, the Town sued to get the land back, and on September 17, 2026 a Fairfax County Circuit Court judge ruled the Town is not entitled to reconveyance. The Town filed objections on September 29 and says it is preparing an appeal. Near the Herndon Metro station, the Town reports that of nine original Transit-Oriented Core parcels, one has been redeveloped, one is under construction, one has been approved and another is in review. Status below is as of October 11, 2026.

Downtown Herndon: The Comstock Case, Step by Step
| Date | What happened |
|---|---|
| Nov. 1, 2017 | The Town signs a comprehensive agreement with Comstock Herndon Venture to redevelop the downtown site with apartments, retail, a parking garage and an arts center. |
| Dec. 2020 | A first amendment to the agreement is signed (Dec. 3), and the Town deeds the property to Comstock. |
| Apr. 29, 2022 | Comstock issues a delay notice. |
| 2024 | Third, fourth and fifth amendments follow (April, August and September); Comstock presents to Town Council on Aug. 13. |
| Dec. 6, 2024 | Comstock notifies the Town it will not proceed, citing factors it says made the project unworkable. |
| Jan. 2025 | The Town notifies Comstock it is exercising what it calls its contractual right to have the property returned. |
| Feb. 28, 2025 | The Town records a declaration of termination in Fairfax County land records. |
| July 11, 2025 | The Town sues in Fairfax County Circuit Court for the return of the parcel at 770 Elden Street. |
| Oct. 29, 2025 | The court overrules Comstock’s demurrer and later sets a three-day trial for Sept. 14, 2026. |
| Jan. to Feb. 2026 | Both sides move for summary judgment; the court hears arguments on Feb. 27. |
| Sept. 4, 2026 | A calendar control order removes the trial date because the pending decision will resolve the case. |
| Sept. 17, 2026 | Judge Tania M.L. Saylor’s opinion finds the Town is not entitled to reconveyance, pointing to the December 2020 deed and the 2020 amendment. |
| Sept. 24 to 25, 2026 | The final order is entered; the Town’s mayor issues a statement. |
| Sept. 28, 2026 | Comstock issues a statement welcoming the ruling and saying it remains willing to work with the Town on redevelopment. |
| Sept. 29, 2026 | The Town announces it has filed objections, a step it says preserves its rights to appeal. |
Where it stands on October 11, 2026: the site remains under Comstock’s control. The Town says it is preparing an appeal; we did not find an appellate filing or decision posted as of this date. We will update this page when either side’s next step is public.
What each side says: the Town says the agreement always meant the land would return if the project did not go forward. Comstock says the deed and the 2020 amendment do not give the Town a right to take the property back.
For nearby buyers: the block is likely to stay as it is while the case continues. If you are buying near Elden, Center or Spring streets, assume the outcome, and any future project’s size and timing, is uncertain.
